The following is to be considered as the agreement applicable to all services and/or products related to the courses presented by Andinia.com LLC ('the company), its representatives and related persons, and each student.
3.1.1)- Purposes. the company provides all material in good faith and for informational purposes only. the company shall not be held responsible for the uses that readers of that material and/or those contracting such services ('students') shall make of it. Students agree not to use this material in any way that may be deemed illegally, and acknowledge the fact that they know the laws applicable on their jurisdiction of residence related to this issue.
3.1.2)- Capability. Those contracting the services of the company declare and certify to be at least eighteen (18) years old of age, and that they are legally apt to sign such contracts. By this act, the person contracting these services assumes full responsibility for this transaction and its consequences. Neither the company neither any of its representatives shall be held responsible in any regarding this issue.
3.1.3)- Grading and scoring. Courses are graded and certifications are issued on approval of all lessons.
Each lesson is graded on a scale ranging from zero (0) to ten (10) points, being the former the lowest possible score, and the latter the highest. On this scale, the student must reach at least seven points to pass, and should have all outstanding bills settled.
The procedure applied for this end shall be as follows:
3.1.3.1)- On confirmation of payment for each lesson, the instructor will send the student the corresponding study guide and material if applicable. the student shall follow all instructions contained therein.
3.1.3.2)- On completion of all instructions, the student shall send the material back to the instructor, who will grade it.
3.1.3.3)- The instructor may or may not approve the material. If it does not pass the score of seven (7) points, the instructor will send the material back to the student for correction.
3.1.3.4)- in the event that student does not pass a lesson he shall have the right to repeat the assignment up to two (2) times without any further payment. Otherwise, the student will have to repay the fee corresponding to the lesson(s) in question again.
3.1.3.5)- in the case that the student were associated to Andinia.com in any way, he shall have to write, for each course, an essay of no more than 8.000 words in length dealing with a related topic of his choice. An additional test will be required in such cases to pass the course. Non-associated students shall not find this mandatory. in the case of associated students, failing to pass these tests will mean that section 3.1.3.4 shall be applied to the whole course, which shall be repeated again (3.1.3.6). There will be no right to participate in the final exam until such an essay and practical tests are passed successfully.
3.1.3.6)- Repeating a course means that the student shall study and pass each lesson corresponding to it independently again.
3.1.3.7)- A student may loose his right to take the final test corresponding to a course in the following cases:
3.1.3.7.1)- After the student does not pass a final test for three consecutive times.
3.1.3.7.2)- If at least two years elapse between the moment in which the student began its course, and the date of the final test.
3.1.3.7.3)- If the company detects any related fraudulent activity.
3.1.3.8)- Theoretical certification shall be defined as the moment in which the instructor sends the student a certificate stating that he has passed successfully all theoretical lessons related to a given course.
3.1.3.9)- Final certification is defined as the moment in which the instructor sends the student a certificate in which is stated that the student has completed all requisites related to a given course.
3.1.3.10)- Thus, courses have a theoretical and practical sections. the first one may be completed without participating in any experiential activity, tests, etc. and after finishing such a section, the student receives a certificate (theoretical certification).
3.1.3.11)- The practical or experiential section may not be commenced by a student until the corresponding theoretical section has been passed successfully. After finishing this second part of a course, the student receives his final certificate.
3.1.3.12)- in the event that a student not associated to the company ('independent') whished to prepare the essay and fulfil other requisites applicable to associated students, the following rules also apply:
3.1.3.12.1)- No fees shall be applied as long as conditions enumerated in section (3.1.3.4) are successfully met.
3.1.3.12.2)- The test corresponding to the practical or empirical section of the course will be always performed within the context of an expedition or an outdoor activity coordinated by the company. This activity shall have its own fees and shall be performed according to conditions enumerated on section 3.1.5.
3.1.4)- The student is advised that these distance learning courses cannot replace directly-supervised training. Neither the company nor its any of its representatives in shall assume any responsibility regarding the acts or consequences derived from the usage that the student may do of or about theses courses. the student acknowledges that he is contracting these products or services at his own risk and assumes full responsibility for this fact, and agrees to act as fully responsible for his acts regarding this issue. We strongly suggest to the student to hire a competent instructor, which may even be a representative of the company, to complete his training under proper supervision.
3.1.5)- Agreements related to expeditions and practical activities. in the event that Andinia.com shall be hired to provide such services, a new contract and new terms and conditions shall be signed.
3.1.6)- Payments. These shall be made in advance and in US Dollars, except on agreement of both parties involved. Return policies shall be as follows:
3.1.6.1)- Returns and devolutions. Payments may be returned up to one week after a sale, and only if the student has not made any use of the material provided by the company.
3.1.6.2)- After the student makes initial use of any product or service, no returns shall be accepted.
3.1.6.3)- Exchanging a given product or service for another equivalent may be accepted if provisions made on Sections (3.1.6.1) and (3.1.6.2) and others related to this agreement are respected.
3.1.7)- Posterior use of products and/or services. the student agrees to the following:
3.1.71)- No commercial use shall be made of the material provided on any of these courses without the written consent of the company. Such products or services shall be used exclusively for personal and private goals except on consent of the company.
3.1.7.3)- No material shall be reproduced by any means except after written consent of the corresponding authors has been issued.
3.1.8)- Additional considerations.
3.1.8.1)- Governing law. This agreement and the rights, powers, duties and remedies of the parties hereunder shall be governed by and interpreted in accordance with the laws of the State of Delaware, USA, and all rights, powers, duties and remedies shall be governed by such laws without regard to principles of conflicts of laws
3.1.8.2)- The company reserves its rights regarding all the intellectual material employed for these courses. Any use of this material by a third party is prohibited without written consent.
3.1.8.4)- These rules shall be deemed as automatically applicable and accepted by the student and the company immediately after the sale of one of the products or services of the company and to the student.
3.1.8.5)- The company reserves its right to amend or modify this agreement or any document related to the products and services described in any way and without further notice. the interpretations of these documents made by the company shall be deemed as final.
As used herein, all pronouns shall include the masculine, feminine and neuter, and all defined terms shall include the singular and plural thereof whenever the context and facts require such construction. the headings, titles and subtitles in this Agreement are inserted for convenience of reference only and are to be ignored in any construction of the provisions of this Agreement. Any references in this Agreement to 'including' shall be deemed to mean 'including without limitation'.
